Privacy Notice

Introduction. Sapphire Funding Partners, LLC, together with any affiliates operating under the Sapphire name ("Sapphire," "we," "us"), takes the privacy of your information seriously. This Privacy Notice explains what information we collect, how we use it, who we share it with, and how we protect it. It applies to anyone who visits sapphirefundingpartners.com (the "Site") or uses the services offered through it, including our funding application (the "Services"). We may revise this notice from time to time and will post the updated version on this page, so please check back periodically.

1. Information we collect. "Personal information" in this notice means information that identifies an individual and that we collect when that person looks for funding on behalf of a business.

Information you give us. When you apply for funding, you give us information about your business and about you as its owner. This may include the business's legal name and any DBA, entity type, industry, time in business, tax ID, street address, average monthly revenue, the amount of funding you are looking for and how you plan to use it, whether the business or its owner has ever filed for bankruptcy, and any other details you choose to add; your name, phone number, email address, date of birth, ownership percentage, estimated credit score range, and Social Security number; and financial records such as bank statements.

Information collected as you use the Site. We automatically collect some information when you browse, such as which pages you view, how often you visit, and what you click; your device type, operating system, and browser; whether you are on a phone or tablet and your carrier; and your approximate location at the city or region level.

Information about other people. If you give us personal information about someone else, you are responsible for having the right to share it and to let us use it as this notice describes.

Information from others. When you apply, we may also receive information about you and your business from funding partners, credit reporting agencies, and data and verification providers.

2. How we use information. We use personal information to provide the Services, improve the Site, and protect our legal rights. This includes using it to:

  • Review your application and decide whether your business qualifies for funding options;
  • Confirm your identity and complete our due diligence;
  • Check the information you give us, including that your business exists and is in good standing;
  • Support any funding you receive, including setting up automatic payments;
  • Tell you about products and services we think may interest you, subject to your choices in section 6;
  • Let you know about changes to the Site or Services and provide support;
  • Maintain, improve, and secure the Site and Services;
  • Look into and act on suspected fraud, illegal activity, threats to anyone's safety, or breaches of our policies or agreements;
  • Enforce this notice and our other agreements, and defend our rights and the rights of others;
  • Carry out any other purpose you provided the information for; and
  • Run our business efficiently and comply with the law.

3. How we share information. We may share personal information:

  • With funding partners, to evaluate your request and present funding options for your business;
  • With vendors that provide services to us, such as hosting, email, data storage and backup, maintenance, and analytics;
  • When the law requires it, or in connection with an actual or expected legal proceeding;
  • To establish, use, or defend legal rights, ours or someone else's, including sharing information to prevent fraud;
  • With anyone we reasonably believe could ask a court or other authority to order the information disclosed, where we think that order would likely be granted;
  • As part of a sale of our business or assets, a merger, acquisition, financing, bankruptcy, or similar event, or while preparing for one;
  • With anyone else when you agree to it; and
  • For any other purpose we tell you about when you give us the information, or where needed to protect the health or safety of others.

We do not sell personal information. We do not share mobile phone numbers or text messaging consent with third parties or affiliates for their own marketing purposes.

4. Cookies and tracking tools. Like most websites, we use cookies, pixels, web beacons, and similar tools (together, "cookies"). Cookies are small files your browser stores on your computer, phone, or tablet. We use them to measure how many people visit and how they use the Site, remember your preferences, show content and services that fit your interests, track ads and search results, fix problems and improve the Site, and recognize you when you come back. Some cookies are set by us and some by other companies.

Your cookie choices. You can block cookies in your browser settings. To learn more, visit www.allaboutcookies.org. You can also opt out of cookies set by specific companies through their own settings pages, and see and manage many advertising cookies through the Network Advertising Initiative and Digital Advertising Alliance websites. These choices only apply to the browser or device you make them on, so you need to repeat them on each one.

Analytics. The Site does not currently use analytics, session recording, or heatmap tools. If Sapphire adds one, this notice will be updated to name the tool, what it collects (such as IP address, visit time, whether you are a returning visitor, and the referring site), and its privacy and opt out pages.

5. Do Not Track signals. Some browsers let you send a "Do Not Track" signal. Because browsers do not send these signals in a consistent way, the Site does not currently change how it works when it receives one.

6. Your choices.

  • Reviewing or changing your information. To see, correct, or update personal information you have given us, email admin@sapphirefundingpartners.com.
  • Marketing emails. Use the unsubscribe link at the bottom of any marketing email, or email admin@sapphirefundingpartners.com with "Opt-Out" in the subject line, or write to Sapphire Funding Partners, LLC, Attn: Marketing Opt-Out, 382 NE 191st Street, #101262, Miami, FL 33179.
  • What to include. Please give your full name and your business mailing address, email address, and phone number. If you only want to stop certain kinds of contact (for example, calls but not email), tell us which ones. Once we find your information, we will update our lists to match your choices.
  • Texts and calls. Reply STOP to any text to stop receiving texts, or tell us during a call or contact us to stop calls.

We may still contact you about an application you have submitted.

7. Security. We use commercially reasonable safeguards to protect the personal information we collect and store against loss, misuse, destruction, and unauthorized access. No security measure or way of sending information over the internet is completely secure, so we cannot guarantee absolute security.

8. Links to other websites. The Site may link to websites we do not control. This notice applies only to information we collect through the Site and Services, and we are not responsible for other websites.

9. Children. The Site and Services are meant for business owners and are not directed to children. We do not knowingly collect, use, or share personal information from children under 13.

10. Notice to Nevada residents. Nevada residents may opt out of the sale of certain personal information. Under Nevada law, a "sale" generally means exchanging that information for money. We do not sell personal information as Nevada law defines it. Nevada residents can still send a verified opt-out request to admin@sapphirefundingpartners.com, and we will record it and follow it if our practices ever change.

11. Notice to California residents. This section applies only to California residents. It describes our online and offline practices and your rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA"). In this section, "personal information" means information that identifies, relates to, or could reasonably be linked to a California resident or household. It does not include publicly available, deidentified, or aggregated information.

  • What we collect. In the 12 months before the date above, we have collected these categories: identifiers (name, postal address, email address, IP address, online identifiers, Social Security number); device identifiers and cookie data; phone number; bank account number; other financial information (bank statements, account history, balances, transaction details, revenue, and payment history); internet activity on the Site; general location; commercial information about your business and personal credit information; professional information, such as your role in the business; age, from date of birth.
  • Where it comes from. From you, from your device, and from funding partners, credit reporting agencies, and data and verification providers. Not every category comes from every source.
  • Why we collect it. The purposes in section 2, plus: keeping the Site and Services secure; finding and fixing errors; short term uses during your visit; providing and supporting our services, including verifying your information and arranging funding; internal research and quality improvement; and marketing, other than cross context behavioral advertising.
  • Selling and sharing. We do not sell personal information, and we do not share it for cross context behavioral advertising. We do not knowingly sell or share the personal information of anyone under 16.
  • Who we disclose it to for business purposes. Identifiers and contact details: funding partners, service providers such as data storage and email, and verification and anti-fraud providers. Social Security number and other government ID: data storage providers and verification and anti-fraud providers, and funding partners. Bank account and other financial information: funding partners, data storage providers, and banks. Credit information: funding partners and verification providers. Location and device data: data storage and security providers.
  • Sensitive personal information. We use sensitive information, such as Social Security numbers and bank account details, only for purposes the CCPA and its regulations allow.
  • Retention. We keep application information as long as needed to review and service your request and to meet legal obligations.
  • Your rights. You have the right to: (1) know what personal information we collect about you, where it comes from, why we collect it, who we disclose it to, and the specific pieces we hold; (2) ask us to delete personal information we collected from you, with some exceptions; (3) ask us to correct inaccurate information; (4) opt out of any sale or sharing, if it occurs; (5) limit use of sensitive personal information, if we use it beyond what the CCPA allows; and (6) not be treated differently for using these rights.
  • How to make a request. Email admin@sapphirefundingpartners.com or call (201) 309-5029. If you are making a request for a California resident, use the same methods, and we will ask for information to confirm you are authorized to act for them.
  • How we verify requests. We act on a request once we confirm your identity, and the identity of anyone you are acting for. For category level requests, or to delete or correct information that is not sensitive, we match at least two pieces of information you gave us before. For requests for specific pieces of information, or to delete or correct sensitive information, we match at least three and may ask for a signed statement, under penalty of perjury, that you are the person the request is about. We may ask for your first and last name, the last four digits of your Social Security number, your date of birth, and your business name. If the details do not match, we will tell you how to proceed.
  • Opting out. Because we do not sell or share personal information, there is nothing to opt out of today. If that changes, we will add a "Do Not Sell or Share My Personal Information" link and honor browser privacy signals such as Global Privacy Control as opt out requests.
  • Shine the Light. We do not share personal information collected through the Site or Services with third parties for their own direct marketing, so California Civil Code section 1798.83 does not require further disclosures from us.
